I. Basic Provisions
The data controllers of personal data pursuant to Art. 4(7) of the GDPR and Act No. 18/2018 Coll. on the Protection of Personal Data are:

The above-mentioned companies act as joint data controllers pursuant to Art. 26 of the GDPR and jointly determine the purposes and means of processing personal data. The joint controllership agreement is available upon request. Under this agreement, AK Navare s.r.o. serves as the primary point of contact for data subjects located in Bratislava and western Slovakia, while Mijamix s.r.o. serves data subjects in Košice and eastern Slovakia. Data subjects may, however, exercise their rights against either of the joint data controllers using the contact details provided above..
II. Scope of Personal Data Processed
The data controller processes personal data solely to the extent necessary for the purposes of this website:
· first and last name
· email address
No other personal data (such as address, payment details, etc.) is collected through this site.
III. Purposes of Personal Data Processing
Personal data is processed for the following purposes:
a) Registration for the waitlist
· recording of interested parties for the Nevarish service before its launch
· informing about the launch of the service, availability, and prices
c) Marketing
· sending newsletters via email
The data controller processes only such personal data as is adequate, relevant, and limited to what is necessary.
IV. Legal Basis for Processing Personal Data
The legal basis for processing personal data is solely the consent of the data subject according to Article 6(1)(a) of the GDPR, provided by checking the relevant box when submitting the form.
For sending SMS messages, a separate, explicit consent is required according to Act No. 452/2021 on electronic communications. Consent to be added to the waitlist or to receive the email newsletter does not automatically imply consent for sending SMS.
Providing data is voluntary. The phone number is not a mandatory field – not providing it does not affect inclusion in the waitlist.
The data controller retains records of consent granted (time, content of consent) for the purpose of demonstrating that consent was given.
There is no automated individual decision-making or profiling according to Article 22 of the GDPR.
V. Data Retention Period
Personal data is stored until consent is revoked, but for no longer than 3 years from the time of provision. After this period, the data will be deleted.
VI. Recipients of Personal Data
Personal data may be shared with:
· providers of emailing and marketing tools, especially in the USA (e.g., Mailchimp or similar platforms)
· providers of IT and hosting services

The data controller may use a double opt-in mechanism to verify the email address, i.e., confirmation of registration by clicking on a link sent to the provided email address.
VII. Transfer of Personal Data to Third Countries
Personal data may be transferred outside the European Union when using emailing, SMS, and marketing platforms.
Such transfer is carried out solely in accordance with the GDPR, through standard contractual clauses according to Article 46(2)(c) of the GDPR or other appropriate safeguards. More information is available upon request.
VIII. Rights of the data subject
The data subject has the right:
· the right to access data (Article 15 GDPR)
· the right to rectification (Article 16 GDPR)
· the right to erasure (Article 17 GDPR)
· the right to restriction of processing (Article 18 GDPR)
· the right to data portability (Article 20 GDPR)
· the right to object to processing, including direct marketing (Article 21 GDPR)
Rights can be exercised by email atinfo@nevarish.sk, bratislava@nevarish.sk or kosice@nevarish.sk, or in writing to the address of the controller. The data controller is obliged to respond within 30 days.
The data subject also has the right to lodge a complaint with a supervisory authority:

IX. Odvolanie súhlasu
Consent to the processing of personal data can be withdrawn at any time:
· by clicking on the “Unsubscribe” link in every email sent
· by email to the address of the controller
· in writing to the postal address of the controller
The withdrawal of consent does not affect the lawfulness of processing before its withdrawal.
X. Zabezpečenie osobných údajov
The controller has taken appropriate technical and organizational measures to protect personal data, in particular:
· data encryption during transmission (SSL/TLS)
· encryption of passwords and sensitive data
· secure access to systems
· access restricted to authorized persons only
Personal data is not made publicly available.
XI. Cookies
The website uses cookies for:
· ensuring the functionality of the site (necessary cookies – processed without consent)
· analyzing traffic (analytical cookies – only based on consent)
· marketing and remarketing, including Meta and Google platforms (marketing cookies – only with consent)
Users can change or withdraw their consent to analytical and marketing cookies at any time through the cookie settings on the website.
Detailed cookie settings are available through the cookie banner on the first visit to the site or in its footer.
Essential cookies are processed based on the legitimate interest of the operator according to Article 6(1)(f) GDPR.

By submitting the form and checking the consent box, you confirm that you have read these policies and agree to them.
The operator reserves the right to update these policies periodically. Interested parties will be informed of significant changes via email.
